Terms of service.
1. Application of Terms
These terms govern all contracts for the sale and delivery of my services to business clients, which include both photography and image editing services.
2. Agreement Framework
The terms of service, combined with my proposal and personal data policy, constitute the complete agreement basis.
3. Reservation, Proposal, and Confirmation of Orders
3.1. Reservations can be made through the website's quote form or via email, phone, or social media.
3.2. Proposals are valid for a duration of 14 days.
3.3. An order is considered confirmed once the proposal and its terms of service have been accepted.
4. Pricing and Offers
4.1. Due to the uniqueness of each photography project, all quotes are customized.
4.2. Amendments or changes after accepting the quote may lead to additional work or overtime not included in the initial offer. You will be notified of any price adjustments before additional work commences.
4.3. The quoted price assumes the project is completed in one delivery (unless agreed otherwise).
4.4. All quoted prices are in GBP.
4.5. Should you require product returns post-photoshoot, mention this at the time of booking. Any resultant shipping costs will be included in the final invoice.
4.6. My rates are subject to change but typically are reviewed annually. Rate changes will not affect valid proposals or already placed orders.
5. Terms of Payment
5.1. Payments can be completed through Bank Transfer, Paypal, or another transfer method. A non-refundable deposit is necessary at the time of reservation, with the balance due on the day of the shoot.
5.2. Costs for specially sourced props or external services (e.g., models, assistants, rentals) will be charged as expenses
6. Cancellation Policy
6.1. Cancellations made less than 7 days before the scheduled shoot incur a 50% charge of the order amount, unless rescheduling within 30 days is possible. Cancellations made over 7 days in advance incur a 25% charge.
6.2. You will also cover any costs for specially ordered props or external services, talents already incurred in preparation for the project upon cancellation.
6.3. Once production begins, the full order amount is chargeable with no cancellation rights.
6.4. Should I cancel, any advance payments will be refunded unless the shoot can be rescheduled within 30 days.
7. Order Fulfillment
7.1. Deliverables are provided digitally via a Wetransfer link, emailed directly to you.
7.2. Images are stored and accessible for download 90 days post-delivery, with options to purchase additional images from the shoot.
7.3. The scope of editing and post-production is agreed upon in the offer, tailored to your objectives and intended use of the images. Additional post-production can be arranged subsequently.
7.4. Delivery formats are agreed upon based on the images' intended application (specified in the offer). RAW format files, considered 'works in progress', are not provided.
7.5. For image selection post-shoot, a gallery link is sent for your review before beginning post-production. A preliminary sorting may be performed.
7.6. Delivery timelines are specified in the offer or order confirmation. Efforts are made to meet these timelines, with prompt notification and rationale provided in case of delays.
7.7. Orders may be cancelled due to my delays if a firm deadline was communicated at booking. No further claims can be made against me for such delays.
8. Feedback and Rectification
8.1. Complaints must be made within a reasonable timeframe to be considered valid.
8.2. Should errors occur on my part, I reserve the right to correct these within a reasonable period without charge.
8.3. If corrections cannot be made timely, you may cancel the related order or receive a price reduction. Note, cancellation forfeits your right to use the images.
8.4. Mistakes resulting from inadequate instructions on your part are not grounds for free rectification or cancellation.
8.5. Usage of the images signifies full acceptance, closing the window for complaints.
9. Copyrights and Usage Rights
9.1. Copyright for all images remains with me. Images are not for resale or duplication.
9.2. While I retain copyright, you are granted usage rights for marketing your company. Should you prefer the images remain unpublished, notify me upon agreement.
9.3. Any desired alterations affecting the images' appearance require prior consent.
9.4. Images in selection galleries are for selection and review only and should not be copied or used outside this context.
10. Limitations of Liability
10.1. My liability is limited to the order amount related to the claim.
10.2. I am not liable for indirect losses, including but not limited to sales, profit, time losses, or legal issues with third parties, except in cases of intentional or gross negligence.
10.3. Force majeure events exempt me from fulfilling obligations.
10.4. I am not responsible for losses or delays due to equipment faults or damage.
11. Information Processing
To engage in an agreement, details such as your name, address, phone number, and email are needed. These details are collected for inquiry processing and service delivery, as outlined in my Privacy Policy
12. Governing Law and Jurisdiction
All contracts and collaborations are governed by UK law, with any disputes resolved in UK courts.
